LGBTIQ+ Rights Case Update: Court Grants More Time to file Evidence.
Mombasa, Kenya – [24-06-2024] – Today, the High Court at Mombasa granted more time to the petitioners to file their evidence in the case of JM and CMRSL vs. The Inspector General of Police & Others (HCCHRPET NO. E048 OF 2023). The case challenges the anti-LGBTQI+ rights movement, its officials, and sponsoring politicians for their campaign of violence against the LGBTQI+ community in Kenya. Additionally, the lawsuit seeks action from the Inspector General of Police and the National Cohesion and Integration Commission for their failure to address the violence and protect the LGBTIQ+ community.
In April 2024, the court issued a temporary order restraining the anti-LGBTQI+ rights group and politicians from inciting violence against the LGBTQI+ community and organizations serving them.
The petitioners, represented by the CMRSL advocate, requested additional time to finalize and submit to court witness statements and documents. The court granted the request, adjourning the hearing until September 17, 2024.
According to Michael representing the petitioners, this extension is crucial to ensure a comprehensive presentation of evidence of the ongoing violence and harassment faced by the LGBTQ+ community in Kenya.
“We are confident that the evidence will demonstrate the need for accountability and create a safer environment for everyone.”.
