HCCHRPET/8/2021, Jow Vs the Director of Public Prosecutions and 3 Others. 

(A case challenging, among others, forced anal examination and HIV testing and seeking to uphold the right against self-incrimination as well as damages for human rights violations.)

This petition came up for mention on 21st September, 2022 before Hon. Lady Justice O. Sewe to fix a judgement date.

However, the matter having been heard and finalised before Hon. Justice J. Mativo who has since been appointed to the Court Appeal, a date for judgement could not be taken. Instead, the court ordered proceedings to be typed and the matter mentioned for further directions on 24th October, 2022.

This petition challenges forced anal examination and forced HIV testing on the basis that they infringe on the right to human dignity, privacy, freedom and security of the person and the rights of an arrested person, among other rights and freedoms guaranteed in the Constitution and Treaties. 

The petition also seeks damages for violations of the named rights and freedoms.
