This petition came up for mention on 24th October, 2022 before Hon. Lady Justice Anne Ong’injo for further directions.
The matter had been heard and finalised before Hon. Justice J. Mativo who has since been appointed to the Court Appeal. Proceedings had not been typed and certified to enable the court fix a judgement date. The matter will be mentioned for further directions on 24th November, 2022.
This petition challenges forced anal examination and forced HIV testing on the basis that they infringe on the right to human dignity, privacy, freedom and security of the person and the rights of an arrested person, among other rights and freedoms guaranteed in the Constitution and Treaties.
The petition also seeks damages for violation of the named rights and freedoms.
